Release of Liability, Assumption of Risk, and Hold Harmless Agreement
I understand that participation in Priest Bass Fishing (“PBF”) activities is voluntary and may involve serious risks. PBF activities include tournaments, championships, meetings, launches, weigh-ins, awards, and other PBF-sanctioned activities occurring on or near the water, at boat ramps, marinas, docks, parking areas, host properties, and event facilities.
These risks may include, but are not limited to, severe or changing weather, lightning, wind, waves, extreme temperatures, deep water, submerged or floating objects, boat traffic, collisions, capsizing, falls, drowning, wildlife, fishing equipment, mechanical or safety-equipment failure, ramp and dock conditions, delayed emergency response, and the actions or negligence of other participants or persons. These risks may result in illness, serious injury, permanent disability, death, or property loss or damage.
I knowingly and voluntarily accept and assume all risks associated with my participation, whether known or unknown, foreseeable or unforeseeable. I am responsible for determining whether conditions are safe for me, my passengers, my boat, and my equipment.
In consideration of being permitted to participate, and to the fullest extent permitted by Tennessee law, I release, waive, and discharge Priest Bass Fishing; its owners, Tournament Directors, officers, staff, volunteers, officials, agents, members, sponsors, vendors, insurers, and affiliates; and participating property owners, ramp operators, marina operators, host facilities, and their respective representatives from claims, liabilities, damages, losses, costs, or expenses arising from or related to my participation.
This release includes claims involving bodily injury, illness, death, property damage, or other loss caused by the ordinary negligence of a released party. It does not apply to gross negligence, reckless or intentional misconduct, or any right or claim that applicable law does not permit to be waived.
I agree not to bring or maintain a claim that I have released under this agreement. To the fullest extent permitted by law, I also agree to hold the released parties harmless from third-party claims, damages, fines, losses, or expenses caused by my unlawful or unsafe conduct, my violation of PBF rules, or my operation of a boat, vehicle, trailer, or equipment.
I understand that PBF does not provide health, life, boat, vehicle, or personal-property insurance for participants. I remain responsible for my medical expenses, equipment, boat, vehicle, trailer, and personal property.
By signing or electronically accepting this agreement, I confirm that I have read and understand it, understand that it affects my legal rights, have had the opportunity to ask questions or seek legal advice, and accept it voluntarily.
